			<content:encoded><![CDATA[<p>Each day that I practice in the field of immigration law, I am struck by the almost daily display of the lack of logic, fairness and good sense in the make-up and application of immigration caselaw, statutes and regulations. Case in point &#8211; a client who arrived here in the early 1960&#8242;s whose father became a U.S. citizen before he turned 18 in 1967. Under present law, he would automatically be a U.S. citizen. But under the law from 1960-2001, he would only be a U.S. citizen if BOTH his parents became U.S. citizens, or if he resided with the U.S. citizen parent, after is parents separated, AND the U.S. citizen parent had LEGAL custody. </p>
<p>He and his mother moved back to her home country of Italy before myclient turned 18, effectively conveying custody to the father, but nothing was done to modify the original custoday agreement when the client soon after came back and moved back in with his father here in Maryland. Both parents are dead, and my client now sits in ICE detention for a crime he committed and served his sentence in 1981, 28 years ago. But for the parents&#8217; not modifying on paper the custody agreement entered into in1971, my client would be a U.S. citizen and would not be locked up by Immigration and Customs Enforcement, and face banishment from the USA , <span style="text-decoration:underline;"><em>a country he has called home for over 50 years.</em></span> It&#8217;s nuts!!       </p>
<p>Given what the current Congress is trying to do in &#8221;reforming&#8221; (translate - takeover) the entire U.S. healthcare system even though vast majority of people are happy with their private insurance, I guess these nonsensical immigration laws are par for the course. But just as the government taking over the entire healthcare system will cost people their lives, these inconsistencies and illogical immigation laws have drastic and brutal consequences for those who fall in their path.    Judges need to be given more latitude in rendering decisions to take into account all the relevant facts and circumstances.     </p>
